Online legal service does not always mean e-signature

The right process depends on the document, the professional involved and the organization or registry receiving it.

FOUR COMMON PATHWAYS

Know which process applies

Fully digital

Intake, advice, ordinary electronic signature, filing and delivery may all occur online.

Lawyer-completed

You work remotely while the lawyer performs certification, trust, registration or filing work.

Remote session + originals

Video witnessing or commissioning may occur, but wet-ink counterparts, originals, couriering or storage are still required.

Hybrid

Most preparation is online, but physical attendance, evidence, a hearing or another offline step is needed.

Wills and powers of attorney

Ontario estate-planning documents generally require a careful paper-original and witnessing process. They should not be advertised as ordinary e-sign documents.

Recipient acceptance matters

For notarized and commissioned documents, confirm that the receiving body accepts the remote act and delivery format before booking.

Confirm

  • Who must sign and witness
  • Whether originals or counterparts are required
  • Accepted identification method
  • Who receives or stores the final original

Prepare

  • Reliable video and private space
  • Unsigned document unless told otherwise
  • Permitted identification
  • Courier or printing arrangements if needed

Protect

  • Use the lawyer’s secure channel
  • Do not send IDs through the marketplace
  • Follow live signing instructions
  • Keep final copies and storage directions
